Shiftapp Terms & Conditions

Please read and agree to these terms before using the Shift app (T/A Shift) and associating website.

Shift, operated by Shift App Ltd (T/A "Shift"), is a company registered in Ireland with its HQ in Dublin. Please read these Terms of Use carefully before using the Shift mobile app, web platform, or any related services.

By accessing or using Shift, you agree to be bound by these terms. If you do not agree, do not use the platform.

1. About Shift

Shift is a platform that connects businesses with workers. Shift is not an employer, and all working relationships are formed directly between the hiring business and the worker.

2. Using the Shift App

Subject to these terms, we grant you a non-transferable, non-exclusive license to use the Shift app on your device. You must not copy, alter, or reverse-engineer the app except where allowed by law.

You are responsible for any device on which the app is used, and any associated data costs.

3. Registration & Onboarding

To use Shift:

• You must complete registration and onboarding checks.
• You are responsible for ensuring your details are accurate and up to date.
• Shift will verify your identity and collect documents relevant to your right to work in Ireland for means of showing on your profile for ease of viewing of potential businesses.
• The final responsibility for confirming a worker’s legal right to work rests with the hiring business.
• You are not employed by Shift. You choose when and where to work, and you are paid directly by the hiring business.
• You are responsible for managing your own taxes and contributions.
• Only valid, unexpired documents are accepted for identity verification and right-to-work checks. Expired documents cannot be used.
• Work is not guaranteed, and opportunities may vary based on demand.

4. Business Registration

To use Shift as a business:

• You must complete registration and compliance checks.
• Businesses are responsible for ensuring accuracy of job posts and onboarding information.
• No employment relationship exists between Shift and any person hired.
• Payments are made directly by your business, through your standard payroll or other agreed methods.
• Businesses pay a platform fee based on their pricing plan (monthly or per-hire).

Shift does not direct, manage, or supervise any work performed by workers.

5. Account Security

You are responsible for keeping your login credentials secure and must not share them. If you suspect unauthorized access, contact us immediately.

We may disable accounts that violate our terms or remain inactive for over 6 months.

6. How Hiring Works

Businesses have the tools to post available jobs/shifts with full details (e.g., role, timing, pay, location). Shift's algorithm matches these with available workers.

Once a worker has connected and been interviewed by a business and is hired, a confirmed booking is created. Shift does not control who accepts a shift — final decisions lie with the businesses.

7. Fees & Payments

• Workers: Free to use and find work.
• Businesses: Charged via monthly tiered pricing.
• VAT is added to all applicable fees.
• Invoices are due within 5 days unless otherwise agreed.
• Failure to pay may result in interest charges or suspension of your account.

8. Content You Submit

You may upload information (profiles, messages, ratings, etc.) — this is your responsibility. Don’t post anything illegal, misleading, or harmful. We may remove or refuse content that breaches these terms.

9. Data & Privacy

Your data is handled in line with our Privacy Policy and Cookie Policy. By using Shift, you agree to our data practices.

10. Marketing & Promotion

We may feature your business (e.g., name, logo, job post) on our platform, website, or social media to promote open roles. You can opt out of being used in case studies or featured content by contacting us.

11. Intellectual Property

You retain rights to any content you submit. By uploading it, you grant us a license to use it for operating the service. We own all rights to the Shift platform and content unless stated otherwise.

12. Limitation of Liability

Shift provides the platform 'as is'. We don't guarantee uninterrupted access or that jobs will be available. We're not liable for any loss from using the service, unless required by law.

You are encouraged to maintain your own insurance coverage.

13. Prohibited Uses

You agree not to:

• Break the law using Shift.
• Post harmful, misleading, or illegal content.
• Access or tamper with other accounts.
• Share platform content without permission.

14. Ending Your Account

You may delete your account at any time. We reserve the right to suspend or remove accounts that breach these terms.

15. Updates to These Terms

We may update these Terms of Use from time to time. We'll notify you of major changes and may require your acceptance to continue using the service.

16. Governing Law

These Terms are governed by Irish law. All disputes shall be subject to the exclusive jurisdiction of Irish courts.
